Time to Clear the Air on Rescheduling Cannabis

There’s a lot of talk right now about reclassifying marijuana under federal law. But before the news turns into myths, it’s time to set the record straight on what rescheduling really means—and what it doesn’t.

First, reclassifying cannabis from Schedule I to Schedule III does not let states change their own laws. Even with rescheduling, state governments must still follow federal rules. States won’t gain new power to override federal guidelines simply because of a new label.

This isn’t the first time we’ve seen rescheduling efforts. In fact, there have been four other attempts in the past—but this is the first time the White House itself has taken the lead. That’s a big shift in how marijuana reform is being handled at the top level—and it deserves proper scrutiny.

Moving cannabis from Schedule I (the category that treats it like heroin or LSD) to Schedule III would mean the federal government recognizes that marijuana has accepted medical use and a lower risk of abuse. Drugs like ketamine and testosterone are already in Schedule III. If marijuana joins them, regulations would loosen—but not vanish.

Some think rescheduling means full legalization, but that’s not true. It doesn’t make marijuana legal across all states. It doesn’t erase criminal penalties under state law. It doesn’t open the door to unrestricted sales or marketing. Rescheduling can help ease research and taxation rules, but it won’t remove laws controlling how and when people can use cannabis.

If anything, rescheduling is a step toward aligning federal policy with modern reality. For years, patients and doctors in many states have relied on cannabis for relief.
