Texas Hemp Retailers Warn New Product Ban Could Devastate Small Businesses

Hemp Retailers

Retailers across Texas are sounding the alarm over a proposed state ban that could wipe hemp-derived products like Delta-8 THC off the shelves—and with it, the livelihoods of thousands of small business owners. A new report highlights just how severe the economic fallout could be if lawmakers move forward with stricter rules on consumable hemp goods.

The bill in question seeks to ban the sale of all hemp-derived products that contain any level of psychoactive cannabinoids not explicitly approved by the federal government. This would include popular compounds like Delta-8 THC, Delta-10, and HHC, which are legally sold under the 2018 Farm Bill but exist in a legal gray area.

Retailers argue that the proposed ban is a direct threat to a booming industry that has helped fill the gap in states like Texas, where marijuana remains illegal. Many of these businesses—especially small, independent shops—rely on hemp-derived products for the majority of their revenue.

Industry leaders say the hemp market has created thousands of jobs, generated millions in tax revenue, and provided access to therapeutic products for people who don’t qualify for or can’t access medical marijuana. Removing these products overnight, they warn, would destroy businesses, disrupt supply chains, and eliminate a vital source of legal relief for consumers.

Advocates also point to the inconsistency of the proposed law. Alcohol and tobacco remain widely available and more heavily linked to public health concerns, yet lawmakers continue to single out hemp. Many see the ban as a politically motivated move to protect entrenched interests or to delay broader cannabis reform in the state.

Meanwhile, public support for hemp products continues to grow, especially among Texans seeking alternatives for anxiety, pain, and sleep disorders. Retailers are urging lawmakers to reconsider the ban and instead focus on reasonable regulations that ensure product safety without dismantling the entire industry.

As the debate unfolds, one thing is clear: Texas is at a crossroads. Will it support small businesses and consumer access—or push an entire legal industry back into the shadows?
