Nebraska Pushes Forward on Medical Marijuana: Lawmakers Work to Implement Voter-Approved Legalization

In November 2024, Nebraska voters approved two significant measures: one legalizing medical cannabis and another establishing the Nebraska Medical Cannabis Commission to oversee its regulation. These initiatives marked a pivotal moment for patients seeking alternative treatments and set the stage for legislative action to implement the new laws. 

The Nebraska Legislature’s General Affairs Committee is currently reviewing multiple bills aimed at structuring the state’s medical marijuana program. Among these, Legislative Bill 651, introduced by Senator Danielle Conrad (D), and LB 677, sponsored by Senator Ben Hansen (NP), propose frameworks for patient registration, licensing of cannabis businesses, and regulations for product cultivation and distribution. Both bills would allow patients to purchase and possess up to five ounces of cannabis.  

A third proposal, LB 705, presented by Senator Terrell McKinney, includes provisions for social equity licensing and addresses expungement and resentencing for individuals with prior cannabis-related convictions. This approach aims to rectify past injustices and promote equitable participation in the emerging cannabis industry.  

Despite these legislative efforts, challenges persist. Nebraska Attorney General Mike Hilgers (R) has initiated legal actions questioning the constitutionality of the voter-approved measures. Acting Deputy Solicitor General Zachary Pohlman cautioned that any legislative steps to implement the new laws could be invalidated if the court rules in favor of these challenges.  

The debate underscores the complexities of aligning voter mandates with legislative processes and legal frameworks. As Nebraska navigates these challenges, the focus remains on developing a medical cannabis program that balances patient access with regulatory oversight. Engaging in informed and open discussions is crucial to ensure that the implementation reflects the will of the voters while addressing legal and societal considerations.
