Congress Demands Probe Into Biden Admin’s Marijuana Rescheduling Process

A Republican-led House subcommittee is calling for a federal investigation into President Biden’s handling of the marijuana rescheduling process. The GOP initiative asserts that the administration deviated from established scientific criteria and ignored mental health risks associated with cannabis.

The move began after the White House Office of National Drug Control Policy announced in early 2025 that it would support a shift of cannabis from Schedule I to Schedule III. Lawmakers on the House Energy and Commerce Oversight panel argued that this decision was made without proper consultation with the Food and Drug Administration (FDA) and may have overlooked studies linking cannabis use to mental health disorders.

In their letter, committee members accused the Biden administration of failing to provide transparency about the scientific evidence and risk-benefit analysis supporting rescheduling. They also criticized what they called an unusually accelerated review process that skipped typical public input phases used in other rescheduling decisions.

Democratic officials and cannabis advocates responded by calling the investigation politically motivated, noting that rescheduling to Schedule III would still impose federal oversight while enabling research, banking access, and potential access to tax credits.

Industry groups, researchers, and legalization advocates warn that a harsh political backlash could stall rescheduling and harm patients and businesses that rely on scientific reform to gain federal legitimacy.

The subcommittee has asked federal agencies to produce internal documents, communications, and scientific reports underpinning the rescheduling decision. They demand a response by the summer of 2025.

As rescheduling efforts continue and the political debate intensifies, this congressional investigation could significantly delay the Biden administration’s goals and potentially alter the regulatory landscape facing the cannabis industry.
